For many Indian professionals in the United States, the immigration journey often feels like a marathon with no finish line.

You came to the U.S. to study, worked hard to secure a job, navigated OPT and STEM OPT, survived the H-1B lottery, and perhaps even received an approved I-140. Yet despite doing everything "right," permanent residency can still feel decades away.

If that sounds familiar, you're not alone.

A growing number of Indian professionals are beginning to explore alternative pathways to a green card, and one option receiving increased attention is the EB-5 Immigrant Investor Program.

Recently, we spoke with immigration and EB-5 specialist Nikin Tharan about why more H-1B workers are considering this route and what prospective applicants should know before making a decision.

Why H-1B Holders Are Looking for Alternatives

The biggest challenge facing many Indian professionals isn't getting a job in the United States, it's the wait for permanent residency.

Because of country-based green card quotas and significant backlogs, many highly skilled workers from India remain dependent on employer sponsorship for years, and sometimes decades.

This creates several challenges:

  • Limited career flexibility
  • Concerns about layoffs and job changes
  • Difficulty pursuing entrepreneurial opportunities
  • Dependence on visa stamping appointments for international travel
  • Uncertainty for spouses and children

Many professionals describe feeling "stuck" despite building successful careers and lives in the United States.

As a result, some are beginning to ask an important question: Is there another path to permanent residency that provides more flexibility and control?

What Is the EB-5 Program?

The EB-5 Immigrant Investor Program allows eligible individuals and their immediate family members to pursue permanent residency through a qualifying investment.

While many people assume the program is only for ultra-wealthy individuals, that perception isn't always accurate.

According to Nikin, many of the families exploring EB-5 today are professionals who have spent 10 or more years building careers in the United States. Over time, they may have accumulated assets through:

  • Savings from employment
  • Company stock and RSUs
  • Investment accounts
  • Home equity
  • Retirement accounts
  • Family gifts
  • Assets held abroad

For some families, the challenge isn't necessarily income, it's understanding how existing assets might be used to qualify, which is why professional guidance is often an important part of the evaluation process.

One of the Biggest Benefits: Greater Flexibility

One reason the EB-5 program has attracted attention in recent years is the ability for many applicants already inside the United States to pursue what's known as "Adjustment of Status."

In practical terms, this means eligible applicants may be able to apply for certain immigration benefits while their case is being processed.

These benefits can include:

  • Employment authorization (EAD)
  • Advance Parole travel authorization
  • A pathway toward conditional permanent residency

For families who have spent years worrying about visa renewals, job changes, or international travel restrictions, this additional flexibility can be appealing.

It may also provide peace of mind during periods of economic uncertainty, particularly for workers in industries that have experienced layoffs.

Why Documentation Matters

For EB-5, it's not enough to simply show that funds exist. Applicants must also demonstrate that the investment funds were obtained lawfully.

This often requires detailed records such as:

  • Tax returns
  • Employment records
  • Bank statements
  • Stock documentation
  • Property records
  • Gift documentation

For individuals who have accumulated assets over many years, gathering this information can take time. That's why experts often encourage interested applicants to begin learning about the process early, even if they haven't made a final decision.

What If You Already Have an Approved I-140?

Many Indian professionals assume that because they already have an approved I-140 petition, exploring another pathway doesn't make sense.

However, Nikin explained that many EB-5 applicants already have approved I-140s and remain in lengthy green card queues. Rather than replacing an approved I-140, some individuals view EB-5 as an additional pathway that may provide a faster route to permanent residency.

Of course, every immigration situation is unique, and consulting with a qualified immigration attorney is essential before making decisions.

If You're Considering EB-5, Start Learning Now

Whether or not EB-5 is right for you, there's an important lesson here: Don't wait until you're facing a visa crisis to understand your options.

Too many international students and professionals spend years focused only on their next immediate step: OPT, STEM OPT, H-1B, or an employer-sponsored green card.

But immigration planning works best when you understand multiple pathways and can make informed decisions well before deadlines arrive. If you're currently on H-1B, waiting in the green card backlog, or simply looking for greater flexibility in your career and future plans, now may be a good time to learn more about all available options. You can book a free discovery call with Nikin here to learn more.

The goal isn't necessarily to pursue EB-5.

The goal is to understand your choices.

Because when it comes to immigration in the United States, knowledge often creates opportunities long before you need them.

The immigration journey is rarely straightforward, especially for Indian professionals navigating long wait times and changing policies. While there is no one-size-fits-all solution, exploring alternative pathways can help you make decisions with greater confidence and less uncertainty.

If you've ever wondered whether there is a different route to a green card beyond employer sponsorship, this may be a conversation worth having. After all, the best immigration strategy isn't the one you discover when you're out of options, it's the one you understand before you need it.
